Mô tả công việc

1. Contract Management:
• Draft and negotiate contracts with Clients, other consultants, Singapore HQ counterparts (Contracts, Legal & Risk Management) and related parties on all matters;
• Carefully review contractual terms and conditions in the format of Company or provided by Clients or another party, highlighting risky clauses and assessing potential issues;
• Suggest alternative contractual wordings to achieve favorable and fair terms for the Company;
• Evaluate the scope of works, program and payment schedule through the coordination with related teams within the Company;
• Support technical teams to deal with Clients on payment requests according to relevant work stage completion, and follow up on the paperwork for payments when needed;
• Monitor and enforce compliance with contract terms, conditions, and deliverables;
• Identify, assess, and manage risks associated with contracts and projects;
• Develop and implement strategies to mitigate risks and resolve disputes effectively;
• Manage any potential liabilities.
2. Contract Custodianship:
• Serve as the custodian of all company contract templates and agreements;
• Continuously refine existing contract templates for each market sector or create new ones as needed to accurately represent the project’s scope of works and deliverables;
• Ensure project contractual requirements are met whilst safe guarding the interest of the Company;
• Ensure that all contracts are complete and accurately represented in both Vietnamese and English.
3. Stakeholder Coordination:
• Liaise and negotiate with clients, other consultants, sub-consultants, and internal teams, acting as the primary point of contact for all contract-related matters;
• Facilitate effective communication and coordination among all relevant parties to ensure smooth project execution;
• Participate in project meetings to provide contractual advice.
4. Documentation & Reporting:
• Maintain comprehensive contract records and documentation;
• Prepare regular reports on contract performance, risks, and issues for senior management;
• Ensure accurate and up-to-date records of all contractual agreements and related correspondence;
• Draft letters on behalf of BOD to respond to contract / services related issues with Clients and/or other parties.
5. Contract Administration on Projects:
• Perform the role of FIDIC Engineer upon request for particular construction projects, including assisting clients in the administration of construction contracts;
• Act as the point of contact for all project communication related to contracts between clients and contractors;
• Provide regular updates on contractual matters to the Client, including design and installation progress, approvals, and outstanding client actions;
• Record contract meetings and maintain document control for all project instructions and communications related to contracts;
• Assist clients in issuing instructions, notices, consents, requests, schedule of defects, certificate of making good defects, variation orders, payment certification, final payment, and statements pursuant to the Conditions of Contract;
• Issue notices to contractors regarding delays, extensions of time, or failure to complete works by the agreed completion date.
